HABR#19-23: Application of Gale Barrett/Shrady for review of an existing emergency generator at a single-family residence. The premises are located at 63 Washington Spring Road, in the Town of Orangetown, Hamlet of Palisades, New York. Chapter 12 of the Code of the Town of Orangetown, Section 12-4(A), Historical Areas Board of Review.
Tax Map Designation: 78.18 / 1 / 16; R-22 zoning district.
Heard by the HISTORICAL AREAS BOARD OF REVIEW at a meeting held on Tuesday, December 10, 2019 at which time the Board made the following determination:
Kier LeVesque, Architect, Bill Bosley, contractor and Gale Barrett, appeared.
The following documents were presented:
- Survey dated September 20, 2019 signed and sealed by William E.es, P.E.,P.L.S..
- One 8” x 10’ color picture of the existing generator.
Bill Bosley stated that the generator was installed after Hurricane Sandy without a permit in 2013; that it is existing on the southerly portion of the property where the air conditioning is and the electric panel; and that the weekly tests for generators should all be done at the same time every week.
Gale Barrett stated that she doesn’t know why she did not get a permit, that her husband was very ill at the time with cancer and she needed the generator installed quickly to keep him in the house; and that no one has ever complained of any noise when the generator is testing itself.

FINDINGS OF FACT:
The Board, after personal observation of the property, hearing all the testimony and reviewing all drawings and plans, and other submissions, correspondence and reports (if any), found as fact, that: The application as presented, would not adversely affect the Historical Areas and the surrounding area. The design and materials for the existing emergency generator.
- The existing emergency generator is located on a patio next to a stone wall.
- The emergency generator is a gray Generac.
THis APPROVAL/decision, INCLUDING THE BOARD’S REQUIRED modifications TO THE APPLICANT’S DRAWINGS AND /OR PLANS, or conditions set forth herein, if any, IS GRANTED BY THE historical areas board of review subject to any such conditions and/or modifications, and is LIMITED TO THE SPECIFIC RELIEF REQUESTED HEREIN.
** PRE-1918 CONSTRUCTION: please be advised: In the Historic Area, all construction requiring a building permit or any exterior changes (including paint color) to buildings constructed prior to 1918, requires approval from the historicAL areas board of review.

Thano Schoppell made a motion to approve the emergency generator for the Barrett/Shrady for property located at 63 Washington Spring Road, Palisades, HABR# 19-23, as submitted, with the following condition: prior approval of the Historical Areas Board of Review is required prior to any change or modification of the requirements and/or conditions set forth in this Decision, which motion was seconded by Loren Plotkin; and carried as follows: William Walther, aye; Thano Schoppel, aye; Margaret Raso, aye; Larry Bucciarelli, aye; Loren Plotkin, aye; and Scott Wheatley, aye. Carol Schelin was absent.
DECISION: In view of the foregoing, and after personal observation of the property, hearing all the testimony before the Board, and reviewing all drawings and plans, and other submissions, correspondence and reports ( if any), the application for the emergency generator is APPROVED, with the following specific condition: prior approval of the Historical Areas Board of Review is required prior to any change or modification of the requirements and /or conditions set forth in this Decision.
The Administrative Aide to the Board is hereby authorized, directed and empowered to sign this decision and file a certified copy thereof in the office of the Town Clerk.

Heard by the HISTORICAL AREAS BOARD OF REVIEW at a meeting held on Tuesday, December 10, 2019 at which time the Board made the following determination:
Charles Vezzetti appeared.
The following documents were presented:
- Plot plan based on a survey done by Adler & Young, P.C., dated 6/1/1986 with the location of the generator drawn it prepared by Billy D. Valentine dated 10/9/2019.
- An 8” x 10” color photograph of the side of the house where the generator is installed.
- Generac 16/20/22 kW guardian series detail sheets ( 6 pages).
Charles Vezzetti stated that they used Valentine Electric to install the generator; that they took care of everything; that after the generator was installed with a building permit they were told that a mistake was made and they needed to appear before the Historic Board; that they never would have installed the generator without appearing before the Board if they knew that they needed to appear; and that he has no problem adding shrubbery in front of the generator along te street side in the spring.
