Bill Walther, Acting Chairperson, called the meeting to order at 7:30 p.m. Hearings on this meeting’s agenda, which are made a part of this meeting, were held as noted below:

HABR#16-12: William Walther, 692 Oak Tree Road, Palisades, 78.17 / 2/ 20; R-40 zone: Amendment includes addition of an emergency generator that shall be placed in the back by the garage and the building permit shall be adjusted to reflect this addition; the garage siding shall match the siding on the house; that door on the south side shall be a window and the window on the east side shall be a door. The generator shall be enclosed by a fence that matches the previously approved fence. A motion to accept these changes was made by Thano Schoppel and seconded by Carol Schelin, and carried unanimously. William Walther recused himself.
THE DECISIONS RELATED TO THE ABOVE HEARINGS are inserted herein and made part of these minutes.
There being no further business to come before the Board, on motion duly made, seconded and carried, the meeting was adjourned at 8:30 P.M.

HABR#17-14: Application of Linda Kupferschmid for review of an emergency generator at a single-family residence located at 23 Heyhoe Woods Road, in the Town of Orangetown, Hamlet of Palisades, New York. Chapter 12 Section 12-4(A), Historic Areas Board of Review.
Tax Numbers: 78.17/2/15.2; R-40 zoning district.
Heard by the HISTORIC AREAS BOARD OF REVIEW at a meeting held on Tuesday, October 10, 2017 at which time the Board made the following determination:
Linda Kupferschmid and Ernest Schlesinger appeared.
The following documents were presented:
- Plot plan dated April 21, 1998 with the latest revision date of September 24, 1998, signed and sealed by Steven J. Collazuol, L.S., P.E.. ( 1 page)
- Four computer generated pictures of the generator.
- Generator Spec sheet.
Linda Kupferschmid stated that her late husband had the generator installed in 2011, about three years into his cancer diagnosis; that he had major surgery in 2012, when Super Storm Sandy hit and she had power and used her fridge to store food for her neighbors and feed the neighborhood; that she realized she needed a permit for the generator recently because she is selling the house; and that there has not been any complaints about the generator.
Bill Walthers stated that there is no zoning location for a generator and there is some ambiguity around generators.

FINDINGS OF FACT:
The Board, after personal observation of the property, hearing all the testimony and reviewing same, found as fact, that: The application as presented, would not adversely affect the Historic District and the surrounding area. The design and materials for the existing emergency generator: (Plot plan dated April 21, 1998 with the latest revision date of September 24, 1998, signed and sealed by Steven J. Collazuol, L.S., P.E.. ( 1 page); Four computer generated pictures of the generator; Generator Spec sheet)
- The existing emergency generator is metal gray.
THis APPROVAL/decision, and any modifications or conditions set forth herein, IS GRANTED BY THE historical area board of review and is LIMITED TO THE SPECIFIC RELIEF REQUESTED AND SUBJECT TO THE CONDITIONS or modifications, IF ANY, SET FORTH HEREIN.
** PRE-1918 CONSTRUCTION: please be advised: In the Historic Area, all construction requiring a building permit or any exterior changes (including paint color) to buildings constructed prior to 1918, requires approval from the historic areas board of review.

DECISION: In view of the foregoing and the testimony before the Board, the application for the existing emergency generator is APPROVED.
The foregoing resolution to approve the generator was presented and moved by Thano Schoppell, seconded by Larry Bucciarelli; and carried as follows: William Walther, aye; Scott Wheatley, aye; Thano Schoppel, aye; Larry Bucciarelli, aye; Carol Schelin, aye; and Wayne Garrison, aye. Margaret Raso was absent.
The Administrative Aide to the Board is hereby authorized, directed and empowered to sign this decision and file a certified copy thereof in the office of the Town Clerk.
