This Special Town Board Meeting was opened at 12:59 p.m. Eliot Tozer, Deputy Supervisor, presided. The Town Clerk called the roll.

RESOLUTION NO. 181 RPC/REFERENDUM PETITION/RECREATION
Councilman Troy offered the following resolution, which was seconded by Councilman Morr and was unanimously adopted:
RESOLVED, that this Town Board enters a Special Town Board Meeting at 12:59 p.m. for discussion concerning a petition received seeking a referendum on a Town Board resolution regarding the Recreation fields at RPC.

RESOLUTION NO. 182 ENTER EXECUTIVE SESSION
Councilman O’Donnell offered the following resolution, which was seconded by Councilman Troy and was unanimously adopted:
RESOLVED, that this Town Board enters Executive Session to discuss potential litigation.

RESOLUTION NO. 183 RE-ENTER STBM
Councilman Morr offered the following resolution, which was seconded by Councilman O’Donnell and was unanimously adopted:
RESOLVED, that this Town Board re-enters Special Town Board meeting.

RESOLUTION NO. 184 RPC/WRITTEN OBJECTIONS RECREATION REFERENDUM
Councilman Morr offered the following resolution, which was seconded by Councilman O’Donnell and was unanimously adopted:
RESOLVED, that the Town Board of the Town of Orangetown has determined to file written objections to the referendum petition filed with the Town Clerk on or about February 23, 2005, relating to the Bond Resolution, duly adopted by the Town Board on January 24,2005, in the amount of $2,550,000.00, and, thereafter, to take such further steps as may be necessary, including but not limited to the commencement and prosecution of a Special Proceeding in New York State Supreme Court, in accordance with the provisions of §91 of the Town Law, for the purpose of having the said Court determine any question with respect thereto; and,
IT IS FURTHER RESOLVED, that the Office of the Town Attorney is hereby authorized and directed to take all necessary steps to effectuate this Resolution.
