The Regular Town Board Meeting was opened at 7:43 p.m. Supervisor Kleiner presided. The Supervisor called the Roll. Present were:

On Saturday, March 19th from 10 a.m. to 12 p.m. there will be a 50th Anniversary Celebration for Mel Liebmann (Mel’s Army and Navy Store) and the Pearl River St. Patrick’s Day parade will be held on Sunday, March 20th at 1:30 p.m.
Public Comment
Catherine Dodge, Orangeburg, Thanked Rich Rose for the excellent job on the Spring 2005 Recreation Programs handbook. She suggested use of a building at RPC to be used by seniors and the youths for activities other than sports.
Eileen Larkin, Palisades, all Orangetown residents should pay the same fee to use the Piermont pier. She suggested groups using the fields be able to purchase the land.
Andrew Wiley, Pearl River, is against the Town Board receiving full-time credit. He questioned the price of the land sold to GAA football and STEJ, the cost of paving the GAA parking lot and the engineering bid process.
Shelly Morgan, Tappan, is against the Patriots advertising for non-residents to play on Orangetown fields. Piermont pier’s fee should be the same for all of Orangetown residents.
Bill Ambrose, Pearl River, believes he is representing the silent majority; thanked the Town Board for all their effort regarding recreation fields. These fields are important to the welfare of our youth.
Ruth Vezzetti, Tappan, questioned the estimates for the GAA lot and if this expense is a gift to them? She suggested non-resident athletics be charged an extra fee.

RESOLUTION NO. 220 MEL LIEBMANN PLAZA WILLIAM ST/PR/MARCH 19TH
Councilman O’Donnell offered the following resolution, which was seconded by Councilwoman Manning and was unanimously adopted:
RESOLVED, that Williams Street in Pearl River from Central Avenue to Franklin Avenue is hereby designated as Mel Liebmann Plaza for March 19 to commemorate Mel’s Army Navy Store’s 50th Anniversary.

RESOLUTION NO. 221 LOCAL ROADS/BRIDGES SUMMIT/GRASSROOTS CAMPAIGN/PERMISSION GRANTED/HIGHWAY

RESOLVED, that permission is granted to the Superintendent of Highways, James Dean, to attend “Local Roads and Bridges Summit and Grassroots Campaign” on March 22-23, 2005 in Albany, NY at a cost of $159 to be charged to Acct. #A 5010/50441.

RESOLUTION NO. 222 IMPLEMENTING WIRELESS COMMUNICATIONS/LAW ENFORCEMENT/PERMISSION GRANTED/POLICE
Councilman O’Donnell offered the following resolution, which was seconded by Councilwoman Manning and was unanimously adopted:
RESOLVED, that permission is granted to a police officer to attend the workshop entitled “Implementing Wireless Communications: Perspective on Interoperability from the Law Enforcement Community” on May 1-5, 2005 in Seattle, WA at no cost to the Town.

RESOLUTION NO. 223 TRI-PARTIE APPEARANCE TICKETS/ADOPTED
Councilman O’Donnell offered the following resolution, which was seconded by Councilwoman Manning and was unanimously adopted:
RESOLVED, that in order to expedite tickets, reduce paperwork and streamline the efficient handling of alleged violations of the Orangetown Code and/or Nyack Code, the standard form appearance tickets for alleged violations of Orangetown ordinances and/or Village of Nyack ordinances, the tri-partite appearance tickets, Exhibit 3-F-05, is hereby adopted to be used by the Orangetown Police Department and the Village of Nyack Police Department.

RESOLUTION NO. 224 PARKING METERS/PEARL RIVER/MACKAY METERS INC/AWARDED BID
Councilman O’Donnell offered the following resolution, which was seconded by Councilwoman Manning and was unanimously adopted:
WHEREAS, the Chief of Police duly advertised for sealed bids for Parking Meters in Pearl River, which were received and publicly opened on December 2, 2004, and
WHEREAS, these bids were referred to the Police Department for recommendation and report, a copy is labeled Exhibit 3-G-05, and made a part of these minutes, Now, Therefore, Be It
RESOLVED, that the bids for Parking Meters in Pearl River is hereby awarded MacKay Meters, Inc. Award amount to be determined after plan is finalized.

RESOLUTION NO. 225 AIA DOCUMENTS/MICHAEL SALYER HOUSE/RECEIVE/FILE

RESOLUTION NO. 226 BLAUVELT FIRE COMPANY BOARD/PERMIT FEES WAIVED
Councilman O’Donnell offered the following resolution, which was seconded by Councilwoman Manning and was unanimously adopted:
RESOLVED, that the request of the Blauvelt Volunteer Fire Company, to waive any or all board fees, permit fees, or fund payments to place a monument in front of the flagpole which already exists on the fire company’s property is hereby approved.

RESOLUTION NO. 227 ACCEPT MINUTES
Councilman O’Donnell offered the following resolution, which was seconded by Councilwoman Manning and was unanimously adopted:
RESOLVED, that the Regular Town Board minutes, Audit Meeting minutes, Executive Session minutes of March 2, 2005 and Executive Session minutes of March 7, 2005 are hereby accepted.

New Business
A discussion took place regarding the amendment to the PAC zone with respect to the number of apartment style dwelling units to be permitted with a single building, and reserving to the Town Board the right to review any proposed site development plan and/or proposed subdivision plat prior to the granting of preliminary approval of such plan and/or plat by the Town Planning Board.
Robert Magrino, Deputy Town Attorney, said pursuant to Law, The Hollows at Blue Hill Senior Housing was referred back to the Town Board to see if it substantially conforms to what was originally proposed.
John Giardello, Director, OBZPAE, explained to the Town Board why this was referred back to the Town Board and asked if there was any objection to the Planning Board serving as Lead Agency for SEQRA purposes.
Donald Brenner, Attorney, said his client is in a position to receive preliminary approval from the Planning Board but a continuance was granted because of this law. The Planning Board didn’t have authority to grant preliminary approval until the Town Board looked at the layout. He feels this design is better than the original one that was presented. His client would like to build this project this year so every week is crucial.
Councilman O’Donnell asked if the 15th hole of the golf course was deeded to the Town?

RESOLUTION NO. 228 THE HOLLOWS AT BLUE HILL FINAL CONCEPT PLAN APPROVED
Under new business Councilman Troy offered the following resolution, which was seconded by Councilwoman Manning and was unanimously adopted:
RESOLVED, that upon a referral by the Planning Board made March 9, 2005, pursuant to Section 4.612 of the Town Code, the Town Board, after review, finds that the proposed site plan for The Hollows at Blue Hill, tax lot Section 73.50 Block 1 Lot 53.2, prepared by Robert J. DeGiorgio, P.E. dated October 21, 2004 and last revised February 3, 2005 does not substantially deviate from the final concept plan presented to and reviewed by the Town Board as part of the Planned Adult Community zone change process.
Further RESOLVED, that the Town Board does not object to the Planning Board of the Town of Orangetown serving as Lead Agency for SEQRA purposes as to the aforementioned site plan.

RESOLVED, that this meeting is hereby adjourned at 8:50 p.m. in memory of Margaret Woods, Pearl River, Tom Meyers, Pearl River, Joe and Cecelia Hince, Pearl River, and David Seeger, Palisades.
