This Town Board Meeting was opened at 7:37 p.m. Supervisor Kleiner presided and the
Town Clerk called the Roll. Present were:

Summary of Public Comment:
Michael Mandel, Pearl River, commended the Town Board for the hiring freeze. He said one
incident does not justify hiring court officers. Spending can be reduced by eliminating Town
owned vehicles being taken home. He asked where the money for Siemen’s escrow,
performance and maintenance contracts is going to come from and why are the years 2003-2004
and 72° being used as baselines.
Genevieve Coffey, Pearl River, thanked Jim Dean, and his staff for a superb job this winter. She
asked when the required non-existence swales abutting her property will be installed. The FAA
Air Space design continues to have negative effects and residents, along with our elected
officials should be contacting our new Senator, Kristian Gillibrand.
Sondra Reiss, Sparkill, asked the Town Board to extend the Sparkill zoning to include 617 Main
Street. She said there is no demand for small office space while there is a healthy demand for
rental apartments.
Eileen Larkin, Palisades, believes the Siemens’ contract needs further discussion and she does
not think the Town will benefit from it. She spoke about its Performance Bond and that the
Town should have the opportunity to cancel at anytime.
Andrew Wiley, Pearl River, said it was inappropriate to receive a letter to honor Thom Kleiner from
Friends of Nyack, a non-profit group, because they receive money from the Town. He spoke about
two companies doing the same lighting upgrades and he said contracts and agreements should
protect the Town.
Henry Rand and his wife, Beth Rand, Nyack, said half a million gallons of sewage spilled into
the Hudson River in Nyack. They asked what kind of Risk Management Plan has been
established. They are concerned that notification is not in place for such a disaster.
The Town Board and Ron Delo had a long discussion regarding the cause of the sewage spill, clean
up procedures and future preventions. Delo said the Police and the contractor, working on the pump
stations, were on site. The County Department of Health and the New York State Department of
Conservation were notified. The area was disinfected and cleaned. He also stated he is still
investigating what caused the pump station to break and he will report back to the Town Board.

Town Code of the Town of Orangetown entitled “Vehicles and Traffic”, Section 39-5.1 entitled
“Fire Lanes” with the current Section 39-5.1 being repealed in its entirety and replaced with a
new Section 39-5.1 is hereby opened.

LOCAL LAW NO. 2 OF 2009
TOWN OF ORANGETOWN
Be it enacted by the Town Board of the Town of Orangetown that Local Law No. 9 of
1972 (Chapter 39 of the Code of the Town of Orangetown entitled “Vehicles and Traffic”,
Section 39-5.1 entitled “Fire Lanes”) as amended by Local Law No. 4 of 2002 is hereby repealed
in its entirety and replaced as follows:
§ 39-5.1. Fire lanes.
A. The Chief of Police, upon the recommendation of the Fire Inspector, subject to the
approval of the Town Board, shall designate a traffic lane or other area designated for use
by fire or other emergency vehicles on any street or in any other public or private street,
driveway, parking area or place in the event of an emergency. Fire and emergency access
lanes shall be in those locations and of sufficient design as may be reasonably required by
the public safety and welfare. The purpose of these lanes is to guarantee unimpaired
ingress and egress in and around public parking areas and to and around all buildings
located in these areas in the event of fire or other emergency, for police, fire and other
emergency vehicles.
B. Said lanes shall be installed by the property owner with acceptable signs and paint on the
pavement provided by said property owner and installed and maintained by the property
owner, and of an approved design of the Bureau of Fire Prevention, and under the
guidance and direction of the Chief of the Bureau of Fire Prevention.
C. Definitions: The words and phrases used in this Section shall have the meanings
respectively ascribed to them by Chapter 71, Title 1, Article 1 of the Vehicle and Traffic
Law of the State of New York.
D. It shall be a violation of these regulations to park any vehicles or store any containers,
receptacles or other material within any lanes or areas designated as a fire lane or fire
zone by the Fire Inspector.
E. All provisions of the New York State Fire Code shall apply to fire lanes.

F. Anything contained in this local law or any other applicable law to the contrary
notwithstanding, any vehicle parked in violation of this regulation shall be towed away
by the Police Department or the Fire Inspector and stored at the expense of the owner,
which expenses shall be paid prior to the redemption of the vehicle. Any change in
property name or ownership shall not affect fire lane designation unless the Fire Lanes
Law is amended and such amendment removes the fire lane designation from that
property.
G. In the Hamlet of Blauvelt
BL 1. All interior roads of the property known as Bradley Industrial Park, 300 Bradley
Corporate Drive (Section 65.18, Block 1, Lot 19), 500 Bradley Corporate Drive
(Section 65.18, Block 1, Lot 21), 700 Bradley Corporate Drive (Section 65.18,
Block 1, Lot 3) and 900 Bradley Corporate Drive (Section 65.18, Block 1, Lot 4),
Blauvelt, New York are hereby designated as fire lanes.
BL 2. All paved portions of 589-597 Route 303, Blauvelt, New York (Section 70.10,
Block 3, Lot 11), except designated parking stalls duly marked with pavement
markings, are hereby designated as fire lanes.
BL 3. All paved portions of North Troop Realty, South Western Highway, Blauvelt,
New York, (Section 76.14, Block 2, Lot 44) except designated parking spaces
duly marked with pavement markings, are hereby designated as fire lanes.
BL 4. Designate the apron of and the parking lot entrance to the Blauvelt Volunteer Fire
Company (Section 70.14, Block 1, Lot 32) as a fire zone.
BL 5. Fire lanes are designated along the Northerly and Westerly curbing along the
stores located on the western side of Westshore Plaza, LLC, located at 580 Route
303, Blauvelt, New York (Section 70.14, Block 4, Lot 13).
BL 6. On the property of the Korean Seventh Day Adventist Church located at 513
Route 303, Blauvelt, New York (Section 74.07 Block 1 Lot 12), there shall be fire
lanes on the entire edge of the horseshoe drive/entryway then continuing on the
southerly edge of the driveway continuing to the rear parking lot and on the
southerly side of the Church not including designated parking spaces duly marked
with pavement markings, and the southerly edge near the proposed residence
continuing to the front parking lot of the church).
H. In the Hamlet of Orangeburg
OB 1. Fire lanes shall be designated on the property of the Holiday Inn of Orangeburg,
329 Route 303 Orangeburg, New York, (Section 74.11, Block 2, Lot 25) as
follows: the area along the front of the building on both sides of the entrance,
except for the area directly in front of the doors and under the canopy, which shall
be a no parking loading zone.
OB 2. Fire zones shall be designated in the Orangeburg Shopping Center, Orangeburg,
New York (Section 74.10, Block 1, Lot 67) for the entire length of Street No. 1
(as defined in Chapter 40) and the entire length of Street No. 2 (as defined in
Chapter 40).
OB 3. Fire lanes shall be designated on the property of Orangeburg Holdings, LLC at the
site of Lowe’s, 206 Route 303, Orangeburg, New York (Section 74.15, Block 1,
Lot 3) as follows: The road designated as the fire department access road on the
South side of the building, the west side of the building from the trash area south
towards the fire department access road, the entire east side of the building except
the designated loading area, and except designated parking spaces duly marked
with pavement markings. OB 4. All paved portions of Chromolloy, 330 Blaisdell Road, Orangeburg, New York
(Section 73.20, Block 1, Lot 1), except designated parking spaces duly marked
with pavement markings, are hereby designated as fire lanes.
OB 5. All paved portions of the property known as 1 Ramland Road, Orangeburg, New
York (Section 73.20, Block 1, Lot 24), except designated parking spaces duly
marked with pavement markings, are hereby designated as fire lanes.

OB 6 All paved portions of the property known as Aluf Plastics Inc. located at 4-10
Glenshaw Street in Orangeburg, New York (Section 70.18, Block 2, Lot 16),
except designated parking spaces duly marked with pavement markings, are
hereby designated as fire lanes.
OB 7. The paved portion of the parking lot in the north, against the building side, located
on the property known as the Town of Orangetown Building Department located
at 20 Greenbush Road, Orangeburg, New York (Section 74.11, Block 1, Lot 20) is
hereby designated as a fire lane.
OB 8 Fire lanes shall be designated on the property of Primagera ShopCent (a/k/a Plaza
2), 500 Route 303, located in Orangeburg, New York (Section 74.01, Block 1, Lot
6) as follows: the western section of the rear of the building identified as the “A”
building in the Shopping Center is hereby designated as fire lane, except that
designated parking spaces marked with pavement markings will not be designated
as fire lanes.
OB 9. Fire lanes are designated on the property of the Sisters of St. Dominic of Blauvelt
known as Rosary Hall located at 496 Western Highway, Blauvelt, New York
(Section 74.06 Block 3 Lot 1.2) at the intersection of the driveway from the fire
hydrant continuing in a southerly direction along the easterly side of the
driveway.
OB 10. Fire lanes shall be designated on the property of U.S.A. Construction, 17 and 17A
Greenbush Road, Orangeburg, New York (Section 74.11, Block 1, Lot 27) as
follows: the entire service road on the north side of the Galaxy Gymnastics
building (17A Greenbush Road) and the entrance road from Greenbush Road on
the north side.
OB 11. On the site of the property known as Barry Packaging Corp. d/b/a Innovative
Plastics, 400 Route 303, Orangeburg, New York (Section 74.07 Block 1 Lot 28),
there shall be fire lanes at the east side of the building continuing around the
building to the West side of the building except designated parking spaces; and
the easterly side of the parking lot along the fence except designated parking
spaces.
OB 12 All paved portions of the property of All American Diner d/b/a American Dream
Diner located at 512 – 514 Route 303, Orangeburg, New York (Section 74.07,
Block 1, Lots 4 and 5) except for designated parking spaces duly marked with
pavement markings and except for the North side of the building.
OB 13. On the site of Orangeburg Salisbury Corp. c/o World Wide Holding Corp., 125
Greenbush Road, Orangeburg, New York (Section 74.07, Block 1, Lot 15.1) that
portion of the lot occupied by Student Bus Company, there shall be fire lanes
designated on the access road located on the Northwest side of the lot from
Greenbush Road for the entire length and the entire east side of the parking lot for
the length of the southerly side of the building, and that portion of the parking lot
located in the southern portion of the lot from the access road to the end, and
continuing on the westerly side of the building.
OB 14. On the site of Bethany-Mar Thoma Church, 94 Old Orangeburg Road,
Orangeburg, New York (Section 74.09 Block 1 Lot 64) in the parking lot area
extending twenty (20’) feet wide from the East (front of the building) and
beginning at Old Orangeburg Road extending one hundred sixty-eight (168’) feet
into the parking lot.
OB 15. All paved portions of the property of the Onnuree Presbyterian Church, 10 Oak
Street, Orangeburg, New York (Section 74.10, Block 1, Lot 28), except for
designated and approved parking spaces duly marked with pavement markings.
OB 16. The paved driveway of the South Orangetown Little League Complex, 200 Old
Orangeburg Road, Orangeburg, New York (Section 73.12, Block 1, Lot 3.1)
extending 311 feet north from Old Orangeburg Road to the concession stand.
I. In the Hamlet of Palisades
PA 1. Fire lanes shall be designated on the north side of the entire length of Yadanza
Court, Palisades, New York.

PA 2. The entire driveway circle located near the main entrance to the Hotel/Conference
Center of the IBM Palisades, 334 Route 9W, Palisades, New York (Section 78.13
Block 1 Lot 1) shall be designated as a fire lane except duly designated parking
spaces.
PA 3 The entire driveway circle located near the building entrance of Palisades Garden,
Inc. (d/b/a The Esplanade at Palisades), 640 Oak Tree Road, Palisades, New York
(Section 78.17 Block 2 Lot 1) shall be designated as a fire lane.
J. In the Hamlet of Pearl River:
PR 1. Fire lanes shall be designated on the property known as of ShopRite of Pearl
River, 56 North Middletown Road, Pearl River, New York (Section 69.13, Block
1, Lot 9) as follows: entire service road on the west side of the buildings, the
entire service road on the northeast side of the building, and the entire service
road on the south side of the building.
PR 2. Fire lanes shall be designated on the property of Woodcrest Realty Company,
West Washington Avenue, Pearl River, New York on the following street
designations:
(1) Access Road No. 1 off West Central Avenue.
(2) Access Road No. 2 off West Central Avenue.
(3) Single continuation of Access Road Nos. 1 and 2 through Woodcrest
Realty Complex existing on West Washington Avenue.
PR 3. Fire lanes shall be designated on the Concourse Level and all access roads to Blue
Hill Plaza One and Two, Pearl River, New York (Section 73.05, Block 1, Lot 54).
PR 4. All interior roads of the Somerset Drive Condominiums located in Pearl River,
New York, (Section 69.05, Block 1, Lot 10), are hereby designated as fire lanes.
PR 5. All paved portions of the Pearl River High School (Section 69.13, Block 3, Lot 2)
located on Central Avenue in Pearl River, New York, except for designated
parking spaces duly marked with pavement markings, are hereby designated as
fire lanes.
PR 6. All paved portions of the property now known as ARC, 56 East Central Avenue
in Pearl River, New York (Section 68.20, Block 2, Lot 2), except designated
parking spaces duly marked with pavement markings, are hereby designated as
fire lanes.
PR 7. Fire lanes shall be designated on the property of the Blue Hill Golf Course, Pearl
River, New York, (Section 73.07, Block 1, Lot 9) as follows: the area on both
sides of roadway directly in front of the main building, restaurant and putting
areas.
PR 8. Empower the Orangetown Police Department to enforce all fire, vehicle and
traffic laws of the State of New York and the Town of Orangetown at the Estates
of Pearl River Condominiums, (Section 68.12 Block 3 Lot 2) located at Crooked
Hill Road in the hamlet of Pearl River.
PR 9. Fire lanes shall be designated on the property of Dexter Plaza (Section 68.20,
Block 1, lots .1/10 through .1/60) located in Pearl River, New York as follows:
all paved portions located on the East and West sides of the building, except for
designated and approved loading and parking spaces, which are to be duly marked
with pavement markings.
PR 10. Fire lanes shall be designated on the property of Northeast Properties containing
the Shop-Rite Liquor Store, 50 North Middletown Road, Pearl River, New York
(Section 69.13, Block 1, Lot 6), as follows: Entire service road on the west side of
the building and the paved areas on the North and South Side not delineated by
parking spots.
PR 11. Fire lanes shall be designated on the property of the Rockhill Building 275 North
Middletown Road, Pearl River, New York (Section 68.12 Block 3 Lot 25) as
follows: the entire length of the driveway on the north side of the building, the
entire length of the driveway on the south side of the building, and the entire rear

of the building, on the western side, is hereby designated as a fire lane, except that
designated parking spaces marked with pavement markings will not be designated
as fire lanes.
PR 12. Fire lanes are designated on the property of Schulter, LLC containing CVS Pearl
River, LLC located at 75 North Middletown Road, (Section 69.13 Block 1, Lot
22) Pearl River, New York as follows: the North side except the gated trash
container area; the east side from beyond the drive through pharmacy; the east
and west side of the parking located on the south side of the lot; the Southwest
corner of the parking lot; and those portions of the driveway not designated
parking spaces..
PR 13. The entire length of the private driveway named Julia Lane in the Garden Hill
Condominium located in Pearl River, New York, (Section 69.17 Block 1 Lots
59.1 through 59.11) is hereby designated as a fire lane.
PR 14. Fire lanes are designated on the property known as The Hollows at Blue Hill
located at Veterans Parkway, Pearl River, New York (Section 73.05, Block 1, Lot
53.2) as follows: On all paved areas other than designated striped parking spaces
located on access roads known as Road “A” (Michael Roberts Court), Road “B”
(Robert McPadden Circle), Road “C” (Kevin Reilly Street) and Fred Ill, Jr. Court.
In addition, the unpaved grass crete area on the West side of Building #6.
PR 15. All paved portions of the property known as TD Bank located at 105 East Central
Avenue, Pearl River, New York (Section 68.16 Block 6 Lot 45) except designated
parking spaces duly marked with pavement striping and except the four drivethrough
lanes.
PR 16. Fire lanes are designated on the property of Mayfair Apartments located at 207- 230 Holt Drive, Pearl River, New York (Section 69.13 Block 1 Lot 4) as follows:
the driveway on the South side of Holt Drive extending 75 feet South from Holt
Drive on both sides leading to the parking area; and 94 feet West from the South
West corner of the driveway directly behind building #208; and the driveway on
the North side of Holt Drive extending 92 feet North on both sides leading to the
parking area.
PR 17. Fire lanes are designated on the property of Cortland Garden Apartments located
at 46-62 East Crooked Hill Road, Pearl River, New York (Section 68.12 Block 2
Lot 6) on the West side of the driveway beginning at East Crooked Hill Road and
extending three hundred thirty-two (332’) feet into the complex. The East side of
the driveway extending one hundred forty-one (141’) feet from the North-West
corner of the building South. In addition, the East and West sides of the parking
circle and the entire area thirty-five (35’) feet in front of the Southwestern most
building in the complex.
PR 18. The driveway of the Georgian Court Apartments 20-29 South Middletown Road,
Pearl River, New York (Section 69.13, Bloc 1, Lot 16) extending 288 feet east
from South Middletown Road and the entire width of the driveway.
PR 19. All paved portions of the property of Blue Hill Development LLC (Promenade at
Blue Hill) 582 Veterans Memorial Drive, Pearl River, New York (Section 73.05,
Block 1, Lot 53), except for designated and approved parking spaces duly marked
with pavement markings. PR 20. All paved portions of the property of Pearl River Associates at 100 North
Middletown Road, Pearl River, New York (Section 69.13, Block 1, Lot 3), except
for designated and approved parking spaces duly marked with pavement
markings.
PR 21. All paved portions of the property of Blue Hill Plaza Inn, Inc. (Pearl River Hilton)
at 500 Veterans Memorial Drive, Pearl River New York (Section 73.10, Block 1,
Lot 1), except for designated and approved parking spaces, and the area directly
in front of the loading dock area extending 25 feet west from the loading dock.
All parking spaces and the loading dock area are to be duly marked with
pavement markings.

K. In the Hamlet of Sparkill
SP 1. Fire lanes are designated on the property of the Our Lady of the Rosary Convent
of the Dominican Sisters of Sparkill at 175 Route 340, Sparkill, New York on the
inner part of the circle near the building’s main entrance from both sides of the
fire hydrant, and continuing in a northerly direction to the gate, and the road
leading to the loading docks except designated parking spaces.
L. In the Hamlet of Tappan
TA 1. Fire lanes shall be designated on the property known as Woodstock Home
Design, 115 Route 303, Tappan, New York, (Section 77.07, Block 2, Lot 1) on
the following street designations:
(1) Main access road.
(2) North secondary road to north parking lot.
TA 2. Signs shall be erected along the frontage to the north and south of the Tappan Fire
District’s Western Highway firehouse on 300 Western Highway, Tappan, New
York (Section 74.18 Block 2 Lot 35) to alert traffic that there is a firehouse
immediately ahead, and fire zone markings shall be painted in front of the truck
bay access on Western Highway.
TA 3. Fire lanes shall be designated on both sides of Birch Tree Lane, Tappan, New
York.
TA 4. Fire lanes shall be designated on the entrance and exit road of Contempra Circle
and the entire right side (outer edge) of the one-way roadway Contempra Circle of
Tappan, Route 303, Tappan, New York (Section 77.11, Block 1, Lots 37 through
45), and those portions of the left side (inner edge) of the one-way circle not
marked or designated as parking, and the access road from Ann Drive to
Contempra Circle, and along the west side of Ann Drive 20 feet from the gate at
the northern end of said Ann Drive.
TA 5. All paved roads, except designated parking spaces at the property known as Noble
Ninth, 120 Western Highway in Tappan, New York (Section 77.06, Block 3, Lot
23), are hereby designated as fire lanes.
TA 6. Fire lanes shall be designated on the property of the Orangetown Jewish Center, 8
Independence Drive, Tappan, New York (Section 74.14 Block 1 Lot 4) as
follows: the south side of the driveway and on the west side of the driveway to
the front door of the building including the U-shaped drive with the crosswalk.
TA 7. All paved portions except designated parking spaces at the property of State Line
Family Restaurant, Inc., 96 Route 303, Tappan, New York (Section 74.11 Block
1 Lot 35) are hereby designated as fire lanes. TA 8. Fire lanes shall be designated on the property of Imperial Sports One, Inc., 64
Route 303 South, Tappan, New York (Section 74.15 Block 1 Lot 42) on the entire
perimeter (North South East and West sides) of the building.
