ANNOUNCEMENTS:
Pearl River Farmer’s Market, sponsored by the Town of Orangetown and the Pearl River Chamber of Commerce. Open every Sunday, from 10 am to 3 pm, through November 24th. The stretch of North William Street (between Washington Ave and Central Ave) will be blocked off and closed to vehicular traffic, during the hours of 7:00 am through 4pm each Sunday. Locally sourced vendors will be gathering at the market to sell fresh produce and other farmer’s market items. The new market place will serve as a healthy and fun meeting place for residents, while also promoting all that downtown Pearl River has to offer. Occasionally, the Market will be accompanied by live music and other amusements.

Rosanna Sfraga, Town Clerk, presented the Affidavits of Publication, Postings and Mailing; proposed local law; and comments from Jane Slavin, Director of OBZPAE, Orangetown Planning Board, Town of Clarkstown, Rockland County Department of Planning, Rockland County Sewer District No. 1, Rockland County Drainage Agency, and Rockland County Highway; which are labeled Exhibit 09-A-19 and made a part of these minutes.
Donald Brenner, Attorney for Petitioner – this property is located at 636 N. Greenbush Rd., Blauvelt and divided into two zoning districts, (“LO” Laboratory Office and “R-40 Low Density Residence. The Petitioner, Bill Brodsky, is requesting the zoning be changed to “MFR” Multifamily Residence. He is looking to build 68 condominium units facing Route 303 with and entrance and exit at the existing traffic light at the intersection of Al Foxie Way and Route 303.
Dr. Paul Olsen, Paleontological, spoke about the topography and the fossil footprints that were found on this site (proto-dinosaurs and other reptiles. The excavation process will find more fossils and extra steps will be taken to preserve them and put into an institution.
Peter Russillo, Maser Consulting PA (Traffic Consultant), personally designed the Route 303 intersection. He said with this zone change, in the morning, you will have about 35 additional vehicles and in the afternoon 45 additional vehicles. Under the existing zoning the vehicles will double. Some improvements to the intersection: a southbound left turn; modification to the traffic signal; and possible an additional crosswalk.
SUMMARY OF COMMENTS (Exhibit 09-B-19 – some of the public comments):
Gabriel Guardarramas, Eva Arijan Auaderear Realty, Brian Stark, Blauvelt; are in favor of this zone change but there should be collaboration with Dr. Olsen regarding the fossil footprints.
Deanna Lamhut, Fran Oldenburger, Joseph & Diane Rossi,Victor & Elayne Armaniaco, Barbara Delo, Ann Brennan, Nicole Palitti, Joseph Levine, Kelly Maris, and Robert Zerilli, Blauvelt; and Susan Nemesdy, Palisades; are against this zone change. They are always concerned about requests for any zone change. This zone change is incompatible with neighboring properties and it is going to affect the character, and cause a reduction in value of the single-family homes in adjacent neighborhoods. There could be negative changes to quiet neighborhoods: dense housing, increased traffic, increased noises and the flavor of the Country road. There is a likely chance that these units do not sell or the builder walks away from this project. This site is unique and should be preserved as open space. They do not want to see Orangetown turn into another Ramapo.
Pete Solari, Blauvelt, is against this zone change. He suggested making this an education site.
Gabe Pasqual, Blauvelt, is in favor of this zone change. The property is going to get developed. He rather have it residential then commercial.
Annmarie Uhll, Blauvelt, asked for clarity regarding the Resolution and the number of units. She is concerned about the increased in traffic and high density housing.
Mike Mandel, Pearl River, this zone change could cause a problem and set a precedent. High density housing is usually in a PAC or TOD zoning district. If approved, conditions should be added.
Mike McCrory Pearl River, spoke about the Entity Disclosure Statement and Law. Before the Town Board takes any action, this complete statement should be submitted.
Sal Battaglia, Blauvelt, asked who is the owner; when was it purchased; why is he donating some of the property; why wasn’t the commercial building built and why not single-family homes.
Bert Von Wurmb, Blauvelt resident and former Orangetown Building Inspector, is against this zone change. The proposed development is not compatible with the neighborhood and he fears this property will get the zone change and then will be sold off. He has heard and read a lot of complaints about Mr. Brodsky’s unfinished developments and illegal building or dumping.
Thom Kleiner, Sparkill, is against this zone change. In the past, a Comprehensive Plan, a Route 303 Sustainable Development Study was done and a Route 303 Overlay Zone was adopted. There was never any proposal or recommendation that the zone be changed from “LO” to “MFR” or any residential zone. Along Route 303, residential zoning was discouraged because it is a commercial corridor. The existing zoning is appropriate for this site.

RESOLUTION NO. 458 ACCEPT ASSISTANCE / SUEZ WATER COMPANY / ENSURE PROPER IRRIGATION OF WALKWAY FOR HEROES (INDEPENDENCE AVENUE, TAPPAN ) / ADOPT-A-SPOT LOCATION
Councilman Diviny offered the following resolution, which was seconded by Councilman Troy and was unanimously adopted:
RESOLVED, that the Town Board hereby graciously accepts the generous donation of assistance from SUEZ WATER COMPANY to install a water service connection on Town of Orangetown owned property described as the Walkway for Heroes Memorial located on Independence Avenue in Tappan. The water connection will hook up to a sprinkler system to ensure proper irrigation of the aforementioned designated Adopt- a-Spot site.

RESOLVED, that upon the recommendation from the Director of Automated Systems, the Town Board hereby approves an AGREEMENT between the Town of Orangetown and Goosetown Enterprises, Inc. for the lease of 26 Panasonic Toughbook Computers with car mounts and 26 Sierra Wireless modems, installation and maintenance included at a cost of $4,290.00 per month for 60 months. Approval is subject to final review by the Town Attorney’s Office.

RESOLUTION NO. 463 APPROVE / AUTHORIZE MOUNTAINVIEW AVE / SPARKILL CREEK CULVERT (PIN 8762.34) TRANSPORTATION PROJECT IMPLEMENTATION / FUNDING 100 % OF THE COSTS FOR THIS PROJECT OF WHICH QUALIFIED COSTS MAY BE REIMBURSED FROM BRIDGE NY FUNDS
Councilman Troy offered the following resolution, which was seconded by Councilman Valentine and was unanimously adopted:
WHEREAS, a project for the Mountainview Avenue over Sparkill Creek Culvert Replacement in the Town of Orangetown, Rockland County, P.I.N. 8762.34 (the “Project”) is eligible for reimbursement of qualified costs from Bridge NY funding that calls for the post-

reimbursement apportionment of the qualified costs be borne at the ratio of 100% Bridge NY funds and 0% non-Bridge NY funds; and
WHEREAS, the New York State Department of Transportation (NYSDOT) will design, let, and administer all phases of the Project.
WHEREAS, the Town of Orangetown desires to advance the Project by making a commitment of 100% of the costs of design and construction work for the Project or portions thereof and
WHEREAS, the Town of Orangetown previously indicated its intention to approve this Project via Resolution 2019-199 and hereby intends to amend such resolution with the adoption of the within resolution,
NOW, THEREFORE, the Orangetown Town Board, duly convened does hereby
RESOLVED, that the Orangetown Town Board hereby approves the Project; and it is hereby further
RESOLVED, that the Orangetown Town Board hereby grants NYSDOT permission to directly apply Bridge NY funds to reimburse costs incurred by NYSDOT on the Project; and it is further
RESOLVED, that the Orangetown Town Board hereby agrees that the Town of Orangetown shall be responsible for all costs of the Project which exceed the amount of the NY Bridge Funding awarded to the Town of Orangetown; and it is further
RESOLVED, that in the event the costs of the Project exceed the amount of Bridge NY funding appropriated, the Orangetown Town Board shall convene as soon as possible to appropriate said excess amount immediately upon the notification by the Supervisor thereof, and it is further
RESOLVED, that the Orangetown Town Board hereby agrees that the Town of Orangetown hereby commits that construction of the Project shall begin no later than twenty-four (24) months after award and the construction phase of the Project shall be completed within thirty (30) months; and it is further
RESOLVED, that the Supervisor of the Town of Orangetown be and is hereby authorized to execute all necessary agreements, certifications or reimbursement requests with NYSDOT for State Aid and/or Bridge NY funding on behalf of the Town of Orangetown in connection with the advancement or approval of the Project and providing for the administration of the Project and the municipality’s funding of the Project costs, and it is further
RESOLVED, that the Town of Orangetown will be responsible for all maintenance of the Project; and it is further
RESOLVED, that a certified copy of this resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement in connection with the Project; and it is further
RESOLVED, this Resolution shall take effect immediately.

The requested light towers will come from the Office of Emergency Management (Chris Jensen), coordinated with the RCHD (Scott Wheatley) & Mike Yannazzone Jr. (OPD). WHEREAS, pursuant to Town Board Resolution 2018-440 and Section 119-0 of the General Municipal Law, the Town of Orangetown entered into an agreement with the Pearl River School District (PRSD) whereby the Town Police Department would assign a School Resource Officer (SRO) to the PRSD for the 2018-19 school year, subject to an annual renewal as set forth in the agreement and
WHEREAS, pursuant to Town Board Resolution 2019-325 the Town agreed to the PRSD request to renew the agreement for the 2019/20 school year, and
WHEREAS, due to a recent change in NYS Education Law 2801-a which requires any such agreements to be consistent with the School District Code of Conduct and clearly delegate the role of school discipline to the school administration, and
WHEREAS, the parties have been acting in accordance with the recent change to the law and wish to add specific language related thereto in to the agreement,
NOW THEREFORE, BE IT RESOLVED, the Town Board hereby agrees to enter into a revised SRO Agreement with the PRSD, subject to the same terms and conditions as set forth in the agreements originally authorized pursuant to Town Board resolutions 2018-440 and 2019-335 with the changes as set forth in the current proposed agreement and authorizes the Town to enter into the SRO agreement with the PRSD, for the 2019- 2020 school year, under the terms and conditions as set forth in the agreement, and the PRSD shall reimburse the Town in accordance with the terms of the agreement.
BE IT FURTHER RESOLVED, that the Town Board hereby authorizes the Supervisor or his designee to execute any documents necessary to effectuate the terms of this resolution, and
BE IT FURTHER RESOLVED that the Town Board hereby authorizes the Chief of Police or his designee to execute any documents necessary to effectuate the terms of this resolution on behalf of the Police Department and to administer same on behalf of the Town and the Town Police Department.

RESOLUTION NO. 473 APPROVE / SETTLEMENT OF PERSONAL INJURY CLAIM (BZ) ROCKLAND COUNTY INDEX NO. 03099/2017
Councilman Diviny offered the following resolution, which was seconded by Councilman Valentine and was unanimously adopted:
RESOLVED, that on the recommendation of the Town Attorney, the Town Board agrees to settle the matter of B.Z., a child, his parents and guardians v. Town of Orangetown, Rockland County Index No. 03099/2017 in the total amount of $925,000.00, to be paid as necessary by the Director of Finance, from surplus funds, to be reimbursed and indemnified pursuant to the Town’s policy of insurance with Princeton Excess and Surplus Lines Insurance Company and the Town’s Third Party Administrator Gallagher Bassett, and the Town Supervisor or his designee is authorized to sign any and all documents in accordance with said settlement in order to effectuate this resolution.
