FINDINGS OF FACT:
- 1. The Board found that the proposed generator would operate only on an emergency basis.
- The Board found that the generator would be installed on a 9′-1 O” 1 /16 length by 4′-3″1/2 length concrete pad, as noted on the submitted plans. The site is presently a blacktopped area.
- 3. The Board found that there are no residential structures nearby and that the generator complies with the Town of Orangetown Noise Ordinanc
- 4. The Board found that the generator will be exercised 20 minutes every
Wednesday morning at 11 :00 a.m.

Board received the following items:

FINDINGS OF FACT:
- The Board found that the proposed generator is the second generator on the site; the first was reviewed and approved by ACABOR on
February 20, 2014 as #14-02.
- The Board found that the proposed generator would be used as a power generation station for the applicant’s industrial use.
- The Board found that the generator would be placed behind an existing structure, parallel to the railroad tracks. The applicant stated that there was a significant amount of space between the proposed generator location and the property line.
- The Board found that the generator complies with the Town of Orangetown Noise Ordinance. Nonetheless, the applicant explained that the generator would have a Sound Blanket enclosure placed over the generator to absorb any sounds. In addition, the applicant noted that a line of mature trees exist at the property boundary that would buffer any sounds from the generator. Moreover, there is a berm near the property line that will further buffer any sounds from the generator.

- 1. The Board found that the applicant proposed one sign placed on the side
of the building. The sign would be carved Extira (wood composite) measuring 120″ wide by 36″ high. The background would be blue with gold letters and border. The tallest letters are approximately 5.5″ high.

- The Board found that the applicant proposed to install an electronic security gate 62 feet from the street line, at the driveway entrance to the site. The security gate would be a vertical pivot gate, 6 feet in height, black in color and manufactured out of metal. The gate would have a backup generator in the event of an electrical failure. The mechanism for the gate would be placed behind the existing stone driveway pillars.
- The Board found that two dead trees had been removed by the applicant, however, the applicant stated that 16 new trees with additional landscaping were planned at the site.
- The Board found that 4 to 5 employees would be working at the site, with no other tenants in the building besides the applicant.

Public Comment:
Daniel Dugan, 36 Kings Highway, Orangeburg; raised concerns regarding the recent removal of two trees at the site. Mr. Dugan also questioned the Board regarding the possibility of increased traffic to Kings Highway due to the new business in the building.
There being no one else to be heard from the public, the Public Hearing portion of the meeting was closed.
DECISION: In view of the foregoing and the testimony before the Board, the application was APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:
- 1. The security gate will be a vertical pivot gate, 6 feet in height, black in color and manufactured out of me
- Trees to be saved shall be protected with snow fencing to the drip line during construction.
- 3. No grading is to take place within five feet of any property line, except as specified on the approved site plan.

The site is located at 1 Sergeant Edward O’Grady Court, off of Sickletown Road, Orangeburg, Town of Orangetown, Rockland County, New York and as shown on the Orangetown Tax Map as Section 69.08, Block 1, Lot
2.2; R-40 zoning district.
Heard by the Architecture and Community Appearance Board of Review of the Town of Orangetown at a meeting held Thursday, November 6, 2014, at which time the Board made the following determinations:
Bill Bosley and Scott Bosley appeared and testified. The Board received the following items:
- Plot Plan prepared John E. Collazuol & Associates, dated September 25,
2014, last revised October 2, 2014.
- Architectural Plans prepared Barry Terach, R.A., dated October 10, 2014: A-1: Foundation, Garage, Upper and Roof Plan
A-2: Front Elevation, Left Side Elevation, Building Section, Rear Elevation, Right Side Elevation

SP-2: Slab-to-Slab Detail Code Specifications
- A copy of the Building Permit Referral, dated October 20, 2014.
FINDINGS OF FACT:
- The Board found that the proposed house had four sides of stucco in off-white color with a shingled roof manufacture by Slateline in a dark color. The window frames would be bronze material. The garage doors would be painted bronze to match the window frames. The air conditioning unit would be placed on the south side of the house, in the rear of the lot.
- The Board found that lighting would be in accordance with Town of
Orangetown safety code.
The hearing was then opened to the Public. There being no one to be heard from the public, the Public Hearing portion of the meeting was closed.
DECISION: In view of the foregoing and the testimony before the Board, the application was APPROVED .SUBJECT TO THE FOLLOWING CONDITIONS:

- 2. Lighting will be in accordance with Town of Orangetown safety code.
- 3. Trees to be saved shall be protected with snow fencing to the drip line during construction.
- 4. No grading is to take place within five feet of any property line, except as specified on the approved site plan.
- 5. The applicant shall comply with the requirements of Section 21-25 of the
Town of Orangetown Shade Tree Ordinance.

York, and as shown on the Orangetown Tax Map as Section 68.16, Block 6, Lot
55 in the CS zoning district.
Heard by the Architecture and Community Appearance Board of Review of the Town of Orangetown at a meeting held Thursday, November 6, 2014, at which time the Board made the following determinations:
Shahanam Shifteh appeared and testified for the applicant. The Board received the following items:
- Sign Plans prepared by Frohling Sign Company, dated August 2014, revised
August 12, 2014.
- Material Sheet, signed by Brian O’Connor, dated October 22, 2014. C. A copy of the Building Permit Referral, dated September 23, 2014. FINDINGS OF FACT:
- The Board found that the applicant proposed to install Ocean Blue color non-illuminated ‘Y4” flat cut acrylic lettering mounted on the building immediately over the front entryway, spelling out “Pearl River Family Dentistry.”
- 2. The Board found that over the doorway, an awning is proposed measuring
30″ in height by 69 ~ ” in length by 30″ deep. The awning would be
Ocean Blue color and in Sunbrella fabric. The Board gave the applicant
the option of placing the street number on the awning or leaving it blank.
The hearing was then opened to the Public. There being no one to be heard from the public, the Public Hearing portion of the meeting was closed.
DECISION: In view of the foregoing and the testimony before the Board, the application was APPROVED AS PRESENTED.
