HABR# 10-01: Application of Tuvia and Joanne Barak for review of a proposed second floor balcony restoration at a single family residence located at 136 Washington Spring Road, in the Town of Orangetown, Hamlet of Palisades, New York. Chapter 12, Section 12-4(A), Historic Areas Board of Review.
Tax Numbers: 78.18 / 1 / 33; R-22 zoning district.
Heard by the HISTORIC AREAS BOARD OF REVIEW at a meeting held on Tuesday, February 9, 2010 at which time the Board made the following determination:
Joanne Barak and Larry Soehnel, contractor, appeared.
The applicant presented the following:
- Hand drawn plans of the existing balcony being exposed and a picture of existing conditions.
Larry Barak stated that they are proposing to restore the upstairs balcony to its’ original state; that some years ago part of the balcony was enclosed with siding to match the rest of the house; that they would like to restore it to its’ original size; and that all of the materials and colors will match the existing house.
PUBLIC COMMENT:
No public comment.
FINDINGS OF FACT:
The Board, after personal observation of the property, hearing all the testimony and reviewing same, found as fact, that:
- The application as presented for the amendment would not adversely affect the Historic District and the surrounding area. The design and materials for the proposed restoration of the balcony are complimentary to the District.
DECISION: In view of the foregoing and the testimony before the Board, the application (Hand drawn plans dated 2/9/10 ) is APPROVED as submitted and presented with the following conditions:
The foregoing resolution was presented and moved by Tom Quinn , seconded by Larry Bucciarelli; and carried as follows: aye; Scott Wheatley, aye; Wayne Garrison, aye. Thano Schoppel, aye; Larry Bucciarelli, aye; and Thomas Quinn, aye. Margaret Raso and William Walther were absent.
The Administrative Aid to the Board is hereby authorized, directed and empowered to sign this decision and file a certified copy thereof in the office of the Town Clerk.

HABR# 10-02: Application of Thomas Migge for review of a proposed sign located at 98 Main Street, in the Town of Orangetown, Hamlet of Tappan, New York. Chapter 12, Section 12-4(A), Historic Areas Board of Review.
Tax Numbers: 77.11 / 3 / 70; CS zoning district.
Heard by the HISTORIC AREAS BOARD OF REVIEW at a meeting held on Tuesday, February 9, 2010 at which time the Board made the following determination:
Tom Migge and Donald Brenner, Attorney, appeared and testified.
The applicant presented the following:
- Copy of the proposed signs.
- Map of Main Street.
Donald Brenner, Attorney, stated that the proposed signs are necessary for the business; that they contain information that Allstate wants on the signs; that they need to go to the Zoning Board for the location of the free standing sign; that it cannot meet the required setback of 20 feet; and that the size of the signs meet the zoning requirements.
Tom Migge stated that the signs will be black and white with gold raised lettering; that they are aluminum and the yard sign will be double sided; that the small 2 x 2 sign is for Brandt Avenue, so that customers will know where to park and enter the building; that the building is commercial and there are other larger signs in the area.
PUBLIC COMMENT:
Carol LaValle, 73 Main Street, Tappan stated that the 4 x 4 sign is already o the building; that the standing sign is large and will loom above the street; that the posts are tall and will already be above street level and create a large blockage in front of the turn by the Tack Box; that the size does contribute to the design; that two large signs are not in keeping with the appearance of other businesses in the area.
Tom LaValle, 73 Main Street, asked if the sign would come back to the Historic Board after it goes to the Zoning Board.
The Chairman stated that the Historic Board is reviewing the design of the sign and not the placement.
FINDINGS OF FACT:
