Margaret Raso, Chair, called the meeting to order at 7:30 p.m. Hearings on this meeting’s agenda, which are made a part of this meeting, were held as noted below:

OTHER BUSINESS:
Mr. Dean, Orangetown Highway Department and Mr. Pang, Rockland County Highway Department discussed placement of traffic lights and the new proposed location of the ground mounted cabinet; several pictures were submitted for the Board to review.
The Board is satisfied with the proposed location of the two lights and the ground mounted cabinet, however they would like to see the cabinet camouflaged with black, green or a color to match the light poles and suggest using stickers that could easily be replaced if damaged. The Board also suggested plantings around the cabinet.
THE DECISIONS RELATED TO THE ABOVE HEARINGS are inserted herein and made part of these minutes.
There being no further business to come before the Board, on motion duly made, seconded and carried, the meeting was adjoined at 9:00 P.M.

HABR# 07-12: Application of Chia-Hu Chang for review of a front yard garden wall to be constructed at an existing single-family residence located at 250 Kings Highway, in the Town of Orangetown, Hamlet of Tappan, New York. Chapter 12, Section 12-4(A), Historic Areas Board of Review.
Tax Numbers: 77.07 / 1 / 38.4; R-15 zoning district.
Heard by the HISTORIC AREAS BOARD OF REVIEW at a meeting held on Monday, September 10, 2007 at which time the Board made the following determination:
Chia-Hu Chang appeared and testified.
The applicant presented the following:
- A survey.
- Hand drawn picture of the proposed garden wall.
Chia-Hu Chang stated that he would like to install a two-foot high garden wall in the front of the house; that it would be 30’ back from the center of Kings Highway as the Building Inspector told him it needs to be; that the pillars on either side of the driveway would be 42” high’ that the stone would be Cambrien blend with the rough side showing out; that the top of the wall would be limestone; that the lights would be inside the pillars and there would be glass facing the road and the driveway for the light to shine through; and that he is before the this Board because the wall will have footings and therefore is considered a structure.
PUBLIC COMMENT:
No public comment.
DECISION: Three votes in favor, one vote opposed, three absentees; therefore the application is Denied. See Town Code Section 18-A 4.
A motion to Approve the application was presented and moved by Henry Shrady, seconded by Ralph Delorenzo; votes as follows; Henry Shrady, aye; Thano Schoppel, absent; Margaret Raso, nay; William Walther, absent; and Ronald Krumm, absent; Scott Wheatley, aye and Ralph DeLorenzo, aye.
The Administrative Aid to the Board is hear by authorized, directed and empowered to sign this decision and file a certified copy thereof in the office of the Town Clerk.

HABR# 07-13: Application of the Children’s Enrichment Center for review of an outdoor playground located at 32 Old Tappan Road, in the Town of Orangetown, Hamlet of Tappan, New York. Chapter 12, Section 12-4(A), Historic Areas Board of Review.
Tax Numbers: 77.10 / 2 / 18; R-15 zoning district.
Heard by the HISTORIC AREAS BOARD OF REVIEW at a meeting held on Monday, September 10, 2007 at which time the Board made the following determination:
Diane Mayer and Leon Baron, Architect appeared and testified.
The applicant presented the following:
- Architectural plans signed and sealed by Leon Baron, Architect, dated 7/13/07 (6 pages) with a picture of the playground attached.
- A letter dated September 10, 2007 not signed.
Diane Mayer, a teacher at the center, stated that this will be the 17th year that the Children’s Enrichment Center has been in existence in Orangetown; that they had previously been located at 680 Oak Tree Road, formerly the Palisades School but relocated because the South Orangetown School District was not sure if they were going to sell the building or not; that they are in front of the Board to ask permission to install a 30’ x 40’ hardwood post and rail fence; that the fence would be a 3-rail fence 4’ high with black welded wire attached on the inside with a 4’ wide single gate; and that the playground equipment would be relocated from the Palisades site to this location.
PUBLIC COMMENT:
No public comment.
FINDINGS OF FACT:
The Board, after personal observation of the property, hearing all the testimony and reviewing same, found as fact, that:
- The application as presented would not adversely affect the Historic District and the surrounding area. The design and materials for the proposed fence are complimentary to the District.
DECISION: In view of the foregoing and the testimony before the Board, the application (Plans dated 7/13/07 signed and sealed by Leon Baron, Registered Architect) is APPROVED as submitted and presented.
