SPECIAL TOWN BOARD MEETING
MONDAY, JUNE 18, 2018
This Special Town Board Meeting was opened at 9:10 am. Supervisor Day presided and the Deputy Clerk called the roll.
Present were:

RESOLUTION NO. 360 APPROVING SUBMISSION OF HOME RULE REQUEST/ PROPOSED AMENDMENT TO CHAPTER 420 OF THE LAWS OF 2013 OF THE STATE OF NEW YORK/ DISCONTINUANCE OF CERTAIN LANDS AS PARK LANDS, AND DEDICATING CERTAIN OTHER LANDS AS PARK LANDS AS BILL WAS AMENDED
Councilman Diviny offered the following resolution, which was seconded by Councilman Bottari and was unanimously adopted:
WHEREAS, on or about October 21, 2013, the New York State Senate and New York State Assembly, pursuant to a Home Rule request by the Town Board as set forth in Resolutions 252, 293 and 299 of 2012, enacted chapter 420 of the laws of 2013 entitled “Property – Deeds and Conveyances-Orangetown” authorizing the Town of Orangetown to discontinue use of certain park lands and sell such lands, and dedicate certain other lands as park lands with respect to certain Town owned lands that were previously part of the Rockland Psychiatric Center, and
WHEREAS, special legislation has been drafted for submission to the NYS Senate by Sen. Carlucci identified as Senate Bill S 835 to make technical corrections to the aforesaid chapter 420 referenced above by amending section 4 of said chapter as set forth more fully therein,
WHEREAS, on June 8, 2018 the Town Board passed a resolution approving the submission of the aforesaid Senate Bill for special state legislation, as well as the corresponding and identical Assembly Bill and
WHEREAS, on June 13, 2018 the aforesaid Senate Bill was Amended on a third reading and which Senate Bill is now identified as S8345A and
WHEREAS, special legislation has been drafted for submission to the NYS Assembly by Assemblywoman Ellen C. Jaffee which is identical to Senate Bill S8345A to make those same corrections and identified as Assembly Bill A-11167, and
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Orangetown hereby requests and approves the submission of a Home Rule Request for the enactment of special state legislation, in the form of Senate Bill S8345A, as amended on June 13, 2018 as set forth above and entitled “AN ACT to amend chapter 420 of the laws of 2013 relating to authorizing the Town of Orangetown, County of Rockland, to discontinue use of certain lands as park lands and sell such lands, and dedicate certain other lands as park lands, in relation to making technical corrections” and its matching Assembly bill of the same title and identified as Assembly Bill A-11167; and

BE IT FURTHER RESOLVED, that the Town Supervisor and Town Clerk are authorized to execute and transmit all documents that may be necessary to effectuate this home rule request.

Supervisor Day offered the following resolution, which was seconded by Councilman Diviny and was unanimously adopted:
RESOLVED, at 9:15 am, the Town Board entered Executive Session to discuss the sale of land.
