This Special Town Board Meeting was opened at 9:10 am. Supervisor Day presided and the Deputy Clerk called the roll.

 

Present were:

Supervisor Chris Day

Councilman Denis Troy

Councilman Thomas Diviny

Councilman Paul Valentine

 

Absent:            Councilman Gerald Bottari

RESOLUTION NO. 358                                          APPROVING SUBMISSION OF HOME RULE REQUEST, RELATING TO A PROPOSED AMENDMENT TO CHAPTER 420 OF THE LAWS OF 2013 OF THE STATE OF NEW YORK RELATING TO DISCONTINUANCE OF CERTAIN LANDS AS PARK LANDS, AND DEDICATING CERTAIN OTHER LANDS AS PARK LANDS

Councilman Diviny offered the following resolution, which was seconded by Councilman Troy and on a roll call was adopted by two-thirds vote:

 

WHEREAS, on or about October 21, 2013, the New York State Senate, pursuant to a Home Rule request by the Town Board as set forth in Resolutions 252, 293 and 299 of 2012, enacted chapter 420 of the laws of 2013 entitled “Property – Deeds and Conveyances-Orangetown” authorizing the Town of Orangetown to discontinue use of certain park lands and sell such lands, and dedicate certain other lands as park lands with respect to certain Town owned lands that were previously part of the Rockland Psychiatric Center, and

WHEREAS, special legislation has been drafted for submission to the NYS Senate by Sen. Carlucci identified as Senate Bill S 835 to make technical corrections to the aforesaid chapter 420 referenced above by amending section 4 of said chapter as set forth more fully therein,

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Orangetown hereby requests and approves the submission of a Home Rule Request for the enactment of special state legislation, in the form of Senate Bill S 8345, entitled “AN ACT to amend chapter 420 of the laws of 2013 relating to authorizing the Town of Orangetown, county of Rockland, to discontinue use of certain lands as park lands and sell such lands, and dedicate certain other lands as park lands, in relation to making technical corrections”; and

BE IT FURTHER RESOLVED, that the Town Supervisor and Town Clerk are authorized to execute and transmit all documents that may be necessary to effectuate this home rule request.

Councilman Diviny offered the following resolution, which was seconded by Councilman Troy and was unanimously adopted:

 

RESOLVED, at 9:12 am, the Town Board adjourned this meeting.
