SPECIAL TOWN BOARD MEETING
TUESDAY, JUNE 23, 2015
The Town Board entered this Special Town Board Meeting at 8:00 p.m. Supervisor Stewart presided and Charlotte Madigan, Town Clerk, called the Roll:
Councilman Denis Troy

Councilman Paul Valentine
Also present: Charlotte Madigan, Town Clerk
John Edwards, Town Attorney
Robert Magrino, Deputy Town Attorney
The Town Board led the Pledge of Allegiance to the Flag.
RESOLUTION NO. 316 LEAD AGENCY / AMENDING THE TOWN CODE / PROHIBITED USES
Supervisor Stewart offered the following resolution, which was seconded by Councilman Morr and was unanimously adopted:
WHEREAS, the Town Board has under consideration a proposed Local Law that would amend the Town Code of the Town of Orangetown, Chapter 43, § 4.4 of the Town Code, entitled “Prohibited uses”, to add “solvents and similar such materials, including benzene, toluene, xylene”, to the § 4.41 listing of prohibited manufacturing uses which involve the primary production of such items from raw materials, and, in addition, also prohibit waste gasification as a process Town-wide under § 4.42; and
WHEREAS, on or about May 12, 2005, the Town Board resolved to circulate amongst various potential involved and interested agencies notice of its intention to assume lead agency status for the purpose of the environmental review of the above referenced action; and
WHEREAS, the Town Board being the only involved agency, and no interested agency having expressed any objection to the Town Board assuming such role, the Town Board may properly assume such role; and
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby declares itself to be lead agency for the purpose of the environmental review of the proposed law;

RESOLUTION NO. 317 SEQRA/NEGATIVE DECLARATION AMENDING THE TOWN CODE PROHIBITED USES
Councilman Troy offered the following resolution, which was seconded by Supervisor Stewart and was unanimously adopted:
RESOLVED, that the Town Board, acting in the capacity of lead agency for environmental review, after taking a “hard look” at all of the potential environmental impacts that might result from the proposed action, has concluded that there will be no significant environmental impacts or effects caused or occasioned by the changes to the Town Code contemplated by the proposed law, and adopts the Negative Declaration annexed hereto (Exhibit

06-E-15), and authorizes the Town Supervisor or his designated agent to execute the Environmental Assessment Form and to take such other and further steps as may be necessary to discharge the Town Board’s responsibilities as Lead Agency.

RESOLUTION NO. 318 ENTER EXECUTIVE SESSION /ARTICLE 78 ANELLOTECH
In attendance, at this Executive Session, were Supervisor Stewart, Councilpersons Troy, Diviny, Morr, and Valentine, John Edwards, and Robert Magrino.
Councilman Troy offered the following resolution, which was seconded by Councilman Valentine and was unanimously adopted:
RESOLVED, at 8:05 p.m., the Town Board entered Executive Session to discuss litigation regarding Article 78 involving Anellotech.
