This Police Commission Meeting was opened at 7:02 pm. Supervisor Day presided and Rosanna Sfraga, Town Clerk, called the roll.

RESOLUTION NO. 601 ENTERED POLICE COMMISSION
Supervisor Day offered the following resolution, which was seconded by Councilman Bottari and was unanimously adopted:
RESOLVED, at 7:02 pm, the Town Board entered the Police Commission to address general police matters.

RESOLUTION NO. 602 ENTERED EXECUTIVE SESSION PERSONNEL MATTERS
In attendance, at this Executive Session, were Supervisor Day, Councilpersons Troy, Diviny, Valentine and Bottari, Michael Lawler, Robert Magrino, Teresa Kenny, Jeff Bencik, Captain Butterworth and Captain Brown.
Supervisor Day offered the following resolution, which was seconded by Councilman Valentine and was unanimously adopted:
RESOLVED, at 7:20 pm the Town Board entered Executive Session to discuss particular Personnel matters.

Supervisor Day and the Town Board members proclaimed Friday, October 12, 2018, Mary O’Sullivan Day in the Town of Orangetown as the 2018 Honoree of the Saint Patrick’s Day Parade Committee.
Supervisor Day announced the appointment of Greg Garvey as the new Economic Development and Tourism Director.
Eagle Scout Benjamin So, Troop 2097, explained his Walkway of Heroes Project of cataloging and creating an inter-active website with a map of the memorial bricks including names and branch of service.
The Town Board and Jim Dean honored Michael Yannazzone for 40+ years of dedicated service to the Orangetown Highway Department.
Richard Loeffler, Site Plan Consultant, presented Bloomberg Data Center proposal for installation of a helipad at 155 Corporate Drive, Orangeburg.
The Town Board reviewed and discussed agenda items 1 thru 50 and voted on the following:
RESOLUTION NO. 604 AID / 2018 TAPPAN YARD SALE GERMAN MASONIC GROUNDS TAPPAN
Councilman Troy offered the following resolution, which was seconded by Councilman Valentine and was unanimously adopted:
RESOLVED, upon the recommendation from the Superintendent of Highways, that the Town Board hereby authorizes the Town of Orangetown Highway Department to lend assistance which includes the use of barrels and barricades, for the Tappan Yard Sale, at the German Masonic Grounds on Saturday, October 13, 2018 (rd: 10.14.18), from 10 am to 4 pm, nunc pro tunc.

RESOLUTION NO. 605 APPOINT / KENNETH SCHMIDT MAINTENANCE MECHANIC II
Councilman Valentine offered the following resolution, which was seconded by Councilman Bottari and was unanimously adopted:
RESOLVED, upon the recommendation of the Superintendent of Parks and Recreation, appoint Kenneth Schmidt to the position of Maintenance Mechanic II, Grade 17, Step 19/24 at a salary of $110,803.00, effective October 15, 2018.

RESOLUTION NO. 606 SHOWMOBILE / NEW CITY FIRE ENGINE CO. #1 / BENEFIT EVENT
Councilman Bottari offered the following resolution, which was seconded by Councilman Troy and was unanimously adopted:
RESOLVED, upon the completion of all necessary paperwork, the Superintendent of Parks & Recreation has forwarded for approval by the Town Board use of the Showmobile at a rental cost of $400.00 by the New City Fire Engine Co. #1 for their Benefit Event on October 20, 2018 with the organization providing a certificate of insurance listing the Town of Orangetown as additionally insured.

RESOLUTION NO. 607 AWARD BID / HOMES FOR HEROES GREEN INNOVATION PROJECT / ENGINEERING AND CONSTRUCTION SERVICES TOMCO CONSTRUCTION INC.
Councilman Valentine offered the following resolution, which was seconded by Councilman Diviny and was unanimously adopted:
WHEREAS, the Superintendent of Highway and the Commissioner of DEME duly advertised for sealed bids for the Homes for Heroes Green Innovation Project, which were received and publicly opened on September 20, 2018,
WHEREAS, Tomco Construction Inc. of Mount Arlington, NJ is the lowest qualified bidder in the amount of $1,412,256; and
THEREFORE, BE IT RESOLVED, that upon recommendation of the Superintendent of Highways and the Commissioner of DEME, the bid of September 20, 2018 for the Homes for Heroes Project is hereby awarded to Tomco Construction Inc., the lowest qualified bidder, in the amount of $1,412,256.00.

RESOLUTION NO. 608 GRANT LICENSES / ACCEPT HOLD HARMLESS & INDEMNIFICATION AGREEMENTS FOR 6, 8 & 10 RYERSON PLACE, TAPPAN (77.14-1-7, 8 and 9)
Councilman Valentine offered the following resolution, which was seconded by Councilman Bottari and was unanimously adopted:
WHEREAS, Ryerson Farms, LLC, developed the properties located at 6 Ryerson Place, Tappan, New York and 10 Ryerson Place, Tappan, New York; and
WHEREAS, Ryerson Estates, LLC, developed the property located at 8 Ryerson Place, Tappan, New York; and
WHEREAS, during the development of the above-referenced properties, the respective developers installed an earthen berm and vegetation encroaching on an existing Town right of way; and
WHEREAS, the matter has been reviewed by the Town Highway Department and the Highway Department has determined that the berm and vegetation may remain in its current location provided the owner of the property provided to the Town an indemnification and hold harmless agreement; and
NOW, THEREFORE, BE IT RESOLVED, that the Town hereby grants to 6 Ryerson Place, Tappan, New York, S/B/L 77.14-1-9; 8 Ryerson Place, Tappan, New York, S/B/L 77.14-1-8; and 10 Ryerson Place, Tappan, New York, S/B/L 77.14-1-7, revocable licenses, in the form of a License, Hold Harmless and Indemnification Agreement for each property, which agreements provide, among other things, that the earthen berm and vegetation may remain in place provided that the owners of the property defend, indemnify and hold harmless the Town for any damage related thereto; and
BE IT FURTHER RESOLVED, that the Superintendent of Highways or the Town Attorney is authorized to execute the respective License, Hold Harmless and Indemnification Agreements and any and all other documents necessary in order for same to be recorded in the Rockland County Clerk’s Office, at the expense of the owner, and to be filed in the Town Clerk’s Office.

RESOLUTION NO. 609 ADJOURNED/MEMORY
Councilman Diviny offered the following resolution, which was seconded by Councilman Bottari and was unanimously adopted:
RESOLVED, at 9:29 pm, the Town Board adjourned, in memory of Dr. Theresa D’Antonio-Krumm, former employee of the Town of Orangetown and former Lt. Colonel of the National Guard; and Dolores A. Jochum, Pearl River and a former RN for the Dominican Convent, Dominican Sisters of Sparkill.
